As of late December 2025, no members or staff of the House Select Committee to Investigate the January 6th Attack have been arrested.
Any potential federal prosecution of these individuals is currently barred by a preemptive presidential pardon issued by Joe Biden on January 20, 2025, just hours before he left office.
This pardon covers all actions taken by committee members and their staff during the course of their official duties on the panel, specifically to protect them from what the former president described as the threat of politically motivated legal retaliation by the incoming administration. Since her confirmation as Attorney General in February 2025, Pam Bondi has taken significant steps to review the conduct of the Department of Justice and the FBI regarding the January 6 investigations.
In June 2025, she dismissed several federal prosecutors who had worked on January 6 cases and later ordered a comprehensive review of all personnel involved in those probes.
Additionally, Bondi’s office has been reviewing congressional referrals from House Republicans regarding the alleged deletion of digital records and archives by the original select committee before it disbanded in early 2023.
While Bondi has frequently stated that she intends to investigate the investigators and hold officials accountable for any perceived abuses of power, her authority is limited by the existing federal pardons.
During her confirmation hearings, she emphasized that the Department of Justice would follow the law and the facts rather than pursuing individuals based on political affiliation. Most recently, her department has focused on unsolved elements of the January 6 events, leading to the December 2025 arrest of a suspect in the long-running investigation into the pipe bombs placed outside the DNC and RNC headquarters in 2021.
