U.S. Senator Mark Kelly became the focus of an "official Command Investigation" by the Department of Defense. The probe was elevated from a preliminary review on December 15, 2025, specifically investigating Kelly for "serious allegations of misconduct" following his appearance in a November video with five other Democratic lawmakers. In the video, the lawmakers reminded military service members of their legal obligation to refuse unlawful orders, a message Defense Secretary Pete Hegseth and President Donald Trump characterized as "seditious."
While six lawmakers participated in the video, the Pentagon has singled out Kelly for a formal military investigation because he is a retired Navy captain. Officials indicated that his retired status makes him subject to the Uniform Code of Military Justice (UCMJ), which could include a recall to active duty for court-martial proceedings. A decision on potential punishment is expected within roughly 30 days.
Kelly has strongly condemned the investigation as a "sham" and an "extraordinary abuse of power" intended to intimidate political opponents. His legal team argued that the probe is unconstitutional and violates the Speech or Debate Clause, which protects members of Congress from prosecution for their official duties. The escalation has also caused unease among some Senate Republicans, who have questioned the prudence of investigating a sitting colleague over political speech
