Kentucky mom no longer facing death penalty in horrific case of her daughter's death. The judge signed off on an order to amend and withdraw the death penalty for Erica Lawson, which means the case now moves ahead as non-capital murder. WATE reported:
Lawson faces charges of murder, failure to report child dependency neglect or abuse, and wanton endangerment, in the death of her 17-month-old daughter. The judge’s order amends the original indictment to change the wording of Count 1 from: “Murder by intentionally causing the death of E.H.” to “Murder by wantonly causing the death of E.H.”
 
The court order stated only murder “accompanied by an aggravating factor or aggravator are eligible for the death penalty.” In addition, for murder to be considered for the death penalty, “intentionality must be proved.” It goes on to explain that the Commonwealth does not believe the death penalty is warranted and cannot prove whether or not the 17-month-old girl was killed intentionally.
