The late Jordan Neely’s father is suing Daniel Penny in a civil lawsuit for negligent contact, assault and battery that caused Neely to pass away.

Penny is the 25-year-old former Marine who was on the subway when Neely was acting erratic and threatening people according to reports. Penny apparently grabbed Neely, went to the ground during struggle, and held him in a chokehold so that he wouldn’t harm anyone on the subway after he made threats.

Penny’s attorney said Neely was “insanely threatening” when Penny got involved. Penny just had the manslaughter charged dismissed. Now the court is trying to figure out what’s next and if they’ll put a lesser charge on Penny.
